TERMS OF USE OF THE ELECTRONIC PHARMACY

This website www.pharmacydepot.gr belongs to the company with the name "SYSTEGAZOMENA FARMAKIA KALLIRROIS VELETAKOU AND IOANNIS MACHAIRA OE" with the distinctive title pharmacydepot cure and care, which is based in Cholargos, Attica (6 Aetideon Street), with VAT No. 800649104, G.E.M. No. 134021803000 T.O. Cholargos, (hereinafter the "Company").

Through the website www.pharmacydepot.gr (hereinafter the "Electronic Pharmacy"), the Company provides the opportunity to:

a. making online purchases of pharmacy products, including but not limited to non-prescription ‘OTC’ medicines, dietary supplements, cosmetics, medical devices, expressly excluding prescription medicines and medicines in execution of medical prescriptions (hereinafter the “Products”),

b. using the “Ask Your Pharmacist” service, which allows visitors/members/customers of the website to address questions regarding the Products of the Electronic Pharmacy, as well as health, nutrition, the use of medicines and dietary supplements, etc., to the Company’s specialized scientific associates. The information, advice, recommendations of the scientific associates provided within the framework of the “Ask Your Pharmacist” service, in no way substitute the advice and/or diagnosis of a doctor, nutritionist, or beautician.

c. browsing and submitting comments/evaluations for the Products available through the Electronic Pharmacy www.pharmacydepot.gr, as well as for the relevant articles about the Products and the companies responsible for issuing and maintaining the relevant import and distribution license in the Greek market (the “Supplier Companies”), which are posted on the “Magazinedepot” blog www.magazinedepot.gr.

d. participating in competitions and various applications (e.g. body mass index quiz etc.) through the Magazinedepot Blog www.magazinedepot.gr.

Before using the Electronic Pharmacy in any way, please carefully read the following terms.

By accessing, browsing, registering and/or using the website for information and/or purchasing products available through the Online Pharmacy, using the “Ask Your Pharmacist” service, as well as browsing/using the blog www.magazinedepot.gr, you declare that you have fully understood these Terms of Use and accept them unreservedly.

1. Purchases through the Online Pharmacy - Registration of new members: The Company provides visitors/members of the website www.pharmacydepot.gr with the ability to make purchases of the Products available in the Online Pharmacy. In order to purchase a Product, it is not necessary for the visitor to register as a member of the Online Pharmacy.

However, those visitors who wish to do so can register as “Members” at www.pharmacydepot.gr by entering their details in the “New Member Registration” option to create their personal account to which they will have exclusive access, so that they can easily and quickly make their purchases at a later time, without it being necessary to enter their details each time they wish to make a purchase through the Online Pharmacy.

Also, those visitors/members/customers who wish to do so can receive informative electronic messages (‘Newsletters’) with offers on Products, discount coupons, new product arrivals, etc. from the Company, by registering on the Newsletter recipient list, by which it is presumed that they consent to receiving them. Visitors/members/customers will have the opportunity to request their deletion from the newsletter recipient list via a hyperlink, which will be contained in the newsletter.

In the event that it is determined in any way that the Member has provided false or incorrect information during his registration at the Online Pharmacy, the Company reserves the right to refuse to complete his registration, to delete his account, to cancel his order and/or any discount coupons that may have been sent to him.

Discount coupons are personal and are not transferable and cannot be used by anyone other than the Member to whom they were sent. Otherwise, the Company reserves the right to cancel the discount coupon. In addition, the Company reserves the right, at its discretion, to stop accepting discount coupons for redemption, without being obliged to notify their holders in advance.

Access to the Member Account requires the use of the “user name” and the “password”, which are sent to the Member by the Company upon registration. In case Members detect unauthorized use of their data, they must immediately inform the Company by sending a relevant message to the e-mail address info@pharmacydepot.gr in order for the Company to proceed with the deletion of their Account and personal data from the Online Pharmacy.

2. Amendments: The Online Pharmacy reserves the right to amend these Terms of Use at any time and without notice, simultaneously updating this text for any change or addition. Each visitor/member/customer uses the Online Pharmacy at his/her own exclusive responsibility, and its content can in no case be considered to provide advice or encouragement, direct or indirect, to visitors/members to purchase any of the Products available through the Online Pharmacy. Modifications to electronic orders are accepted only within 2 hours of the order time.

3. Users/Customers of the Electronic Pharmacy: The website www.pharmacydepot.gr and the products available through it are addressed exclusively to adults with full legal capacity. In particular, the use, visit of the website www.pharmacydepot.gr and/or ordering products through it by minors is prohibited. The Electronic Pharmacy bears absolutely no responsibility for the visit and/or use of the website by minors/incompetent persons, since it is not possible to verify the identity and age of the visitors/members/customers of the Electronic Pharmacy.

4. Products available through the Online Pharmacy: The Company procures all Products available for sale through the Online Pharmacy from the Supplier Companies. The Pharmacy reserves the right to discontinue at any time and without prior notice supporting the operation of the Online Pharmacy, as well as the sale of Products through it.

5. Order Form: In order to complete the product order, you must complete all the information requested in the Order Form, which corresponds to the Product you wish to purchase and submit it to the Online Pharmacy after completing it.

6. Confirmation Email/Contract Formation: Upon receipt of your Order Form, the Company sends you an email to confirm receipt of your order. It is expressly agreed that the contract between the Company and the Customer is concluded once the Company confirms receipt of the Order Form, with a corresponding e-mail message, which it sends to the Customer.

The Company reserves the right to cancel the order, as well as not to proceed with its execution, in the event that it is found that the Customer has declared false or incorrect information in the Order Form or in the event that the order information cannot be confirmed and/or does not correspond to the current pricing policy.

The Company reserves the right to send the ordered products in parts if this is deemed appropriate for reasons that serve the shipping system and the Customer. The Customer is not charged additional shipping costs.

The Company reserves the right not to send an order form from the moment an amount due - shipping and/or product value - is determined until the amount is finally paid.

7. Order Cancellations / Product Returns: Each Customer has the right to cancel the order of Products sent through the Online Pharmacy within two (2) hours of sending the relevant order to the Company, by sending an e-mail to cancel@pharmacydepot.gr. Cancellations of orders that have been sent are not accepted and the customer is responsible for the shipping and return costs of the package.

Each Customer has the right to withdraw from the Products ordered through the Electronic Pharmacy, in case they are not satisfied for any reason, by sending a fully completed withdrawal form using a fax message (fax) 210 – 6529568 or an email message (email) to the address returns@pharmacydepot.gr. Returns are accepted under the following conditions:

7.1. The return must be made within fourteen (14) calendar days from the date of receipt of the product for products delivered within Greece and within twenty (20) calendar days for products delivered abroad. The return must be accompanied by a fully completed withdrawal form which has been sent via (fax) 210 – 6529568 or by email to returns@pharmacydepot.gr.

7.2. Returns of products on offer or other perishable products that can deteriorate or expire soon (e.g. baby milk, creams, etc.) are not accepted, unless there is a recall of a product batch by the supplier company. In the event of a recall of a batch by the supplier company, the products may be replaced with products of equal value until the date strictly set by the supplier company. In the event that the batch of products does not belong to a batch of the supplier company under recall, 7.8 applies.

7.3. The returned product must be unused, in excellent condition, exactly as it was before the sale in its packaging and with all its contents, as well as any gift that may have been included.

7.4. The returned product must be accompanied by the original purchase document (retail receipt or invoice).

7.5. In the event that the product delivered presents a problem during its operation, the Customer is obliged to inform the Company as soon as possible about the problem that occurred. If the product is covered by a warranty, the customer must contact the manufacturer or the relevant agency in order to be served regarding the problem he is facing with the device.

7.6. To return the Product, you must contact the Company via e-mail returns@pharmacydepot.gr or via fax 210-6529568.

7.7. In the event that the Product delivered is defective (e.g. its packaging has been damaged during transport), the Customer may return the product ONLY to the physical store at his own expense. Defective products are replaced with new ones of equal value.

7.8. In case you simply wish to return a product because it is not to your liking, the shipping and return costs are borne by you. Refunds are not made in this case and the products must be replaced with others of equal value. Returned products must not have been opened or used in any way. Products that were delivered late or at an undesirable time are not returned under any circumstances. However, if you exercise the right to refuse receipt or the package is classified as unclaimed, you will be charged both the shipping and return costs of the package(s).

8. Product return procedure and methods: in case the above return conditions are met, you can return the Product you purchased:

8.1. At the Company's store: by going to its store in Cholargos, Attica (6 Aetideon Street), in order for the Company's staff to check the condition of the product and guide you on the refund process or the replacement of the Product with another one.

8.2. Shipping via courier agency: in case your attendance at the Company's store is not possible, you can send us the product via courier agency to the attention of the Returns Department, informing us at the same time if you wish to replace the product or refund your money. The shipping costs are borne by the sender of the returned products.

In case the Online Pharmacy deems that the conditions for the return of the product are not met, then the Product will be returned to the Customer and the shipping costs will be borne by him.

9. Product Prices: The Company makes every effort to ensure that the prices displayed in the Online Pharmacy next to the Product images are correct. However, in the event of a difference between the price displayed next to the Product and the price of the same Product on the Order Form, it will be accepted that the price of the Product is the one that corresponds to the company's current pricing policy.

10. Depot card: The depot card cannot be used for your purchases through the Online Store.

11. Product Payment: You can pay for your order in the following ways:

11.1. Cash on delivery: possibility of paying for your order with cash upon delivery of the product(s) you have purchased. The cash on delivery option is only offered for domestic orders.

11.2. Credit Card: possibility of using your credit card (Visa or Mastercard) after completing your order. Diners & American Express cards are not accepted. In order to complete the order of the product(s) you want, you must complete all fields of the order form (name, card number, expiration date and issuing bank).

11.3. Deposit to a bank account: possibility of payment via a bank account. The bank accounts to which you can deposit the money are:

In order to complete your order, after depositing the money into the above bank account, you can send us the deposit receipt to fax no.: 210- 6529568. The amount of the order must be paid in full. Any bank charges are entirely borne by the customer. In the event that the customer deducts any bank charges from the total amount of the order, the company reserves the right not to ship the order until the total cost of the order has been paid in full.

11.4. Payment in store: Upon receipt of your products, you also pay the price of them (Address: Aetideon 6, Cholargos, Athens, Greece). In case you go to the store without having previously placed an order in the online store or without having previously prepared your order, the current pricing policy of the physical store and not the online store applies.

11.5. In case your order amounts to more than one thousand (€ 1,000), its payment will only be made upon payment of the amount to a bank account and presentation of the relevant deposit receipt. A relevant message will be displayed during the order.

11.7. In the event of failure to pay the amount due (e.g. in cases of cash on delivery) for the purchase and delivery of the Products, the Company reserves the right to request the return of the Product at the expense of the Customer.

11.8. Customers are responsible for choosing the payment method that is consistent with the applicable tax legislation, in particular with regard to the maximum permitted transaction limits above which the use of a bank account is required.

12. Availability and delivery time of Products:

The Products displayed in the Online Store are immediately available and can be shipped by the Company within 2-3 working days from the day of the order (provided the order has been placed by 13:00), with minimal exceptions for reasons attributable mainly to the Supplier Companies (e.g. lack of availability, exhaustion of stocks, cancellation/recall of a batch, etc.) to mainland central destinations. For shipments to island and remote destinations, the delivery time is 5-7 working days.

The Company does not provide any guarantee and bears no responsibility regarding the availability of the products as this is constantly changing. In the event of unavailability of a product for which an order has been placed, the Company will inform the customer by telephone. In case of non-receipt of this or inability to verify the details of his order, he must contact the company to execute his order, otherwise the order will be canceled. Also, the Company bears no responsibility in the event that the Supplier Companies renew/modify the packaging of a Product, increase its price or proceed with its abolition. In the event of a price modification by the Supplier Company, the company may modify the price in the order to be processed and not execute it in the event that the customer refuses to receive the products at the new price. The same applies in the event that the company modifies its pricing policy or changes the prices of the products on offer. All products that have a price lower than the original are considered to be Products on offer.

The delivery time filled in during the order is indicative and in no way binding for its execution and receipt. Same-day deliveries and commitments for delivery on a specific day and/or time are made only after telephone communication with the store and are subject to additional charges on the entire order. Deliveries on Saturday within Greece are only made with a charge of 2.2 euros in addition to the amount of the order. Saturday pickups from the respective local courier store are carried out without additional charge.

The Online Pharmacy is not responsible in cases of late delivery of the Products by the shipping company to the Customer, as well as in cases of delivery at a different time than the indicative time filled in on the order form. The Customer expressly consents and accepts that late delivery or an undesirable delivery time is not a reason for refusing to receive the Products and repaying the amount due to the Company regarding the relevant order. In any case, the Customer is responsible for ensuring the timely delivery of his products or the collection of them from the locally cooperating courier agencies/post offices. If he exercises the right to refuse receipt or the package is classified as unclaimed and returned, then the Customer must pay the amount of the shipping and return costs of the products of his order.

Also, the Online Pharmacy is not responsible for the delivery and collection time of the Products in cases of strikes, holidays, extreme weather events. The Online Pharmacy is also not responsible for the delivery time in inaccessible areas, as determined by the courier companies cooperating with the Online Pharmacy.

Online orders for delivery by Courier are sent exclusively with the shipping companies cooperating with the Online Pharmacy.

In case the Customer wishes to receive the product from the Courier store, it must be stated from the beginning in the comments of his order. If it is not stated, no modification can be made to the shipment afterwards, unless the Customer accepts to be charged with the costs of a new shipment.

13. Shipping costs: Shipping costs for orders over fifty euros (€ 50) will be free throughout Greece as long as the orders are up to 2 kilos. For each additional kilo there will be a charge of 1 euro. In the event that the volume of products exceeds the stipulated charge per kilo, the charge is made based on volume and the order is subject to an extra charge according to the pricing policy of the respective cooperating transport company.

For deliveries of products in orders under 50 euros, the shipping cost will be 2 euros and for orders up to 2 kilos. For each additional kilo there is an extra charge of 1 euro. The cost of shipping in case the stipulated volume is exceeded is formed according to the pricing policy of the respective cooperating transport company. For sending gifts there is an additional charge of 1 euro. The cost of cash on delivery is 2 euros in each case, regardless of the order amount. Bank deposit and credit card payment do not have any additional charges.

Abroad, the amount of shipping costs varies depending on the country of shipment and the weight of the products. The amount of shipping costs is displayed on the screen at the time of ordering and before its completion.

14. Warranty: The website provides the content (e.g. information, names, photos, illustrations, description of ingredients and instructions for use) "exactly as they are" without any express or implied warranty.

15. Disclaimer/Limitation of Liability: The use of the Electronic Pharmacy www.pharmacydepot.gr is done exclusively at your own risk. The Company makes every effort to ensure the high level of the Products and services offered through the website.

The Company does not guarantee that the content of the Electronic Pharmacy and the Magazinedepot Blog, as well as the quality of the services provided, will meet the needs, requirements, expectations of its members/customers. The product descriptions are indicative, as are the product photos. The Company is not responsible in the event of a change in the packaging and composition of the products by the supplier company. The Company shall not be liable for any claims (civil and/or criminal), as well as for any damage (positive or consequential), which may arise for the members/customers of the website or for third parties due to a reason related to the operation or non-operation of the Electronic Pharmacy and the Magazinedepot Blog and/or the inability to provide services and information available through it or any third party interventions in Products and information available through it. The Company shall not be liable for any claims (civil and/or criminal), as well as for any damage (positive or consequential), which may arise from the use of the product, as the Customer must check the product before use (expiration date, packaging and proper functioning, etc.).

The content, information and advice provided by the Online Pharmacy, particularly within the framework of the “Ask your Pharmacist” service, do not constitute and cannot in any case be considered to constitute medical, pharmaceutical or other advice, nor do they in any way conceal any such relationship between the Company and the visitor/member/customer or an incitement to specific actions, whether business or otherwise.

The Company is not responsible for the safety of the use of the products sold. This is the responsibility of the suppliers who produce the products and the customer who uses the products. In the event that a supplier recalls a batch of products, the Company has no other responsibility towards the customer, except for replacing the recalled products with other products of equal value within the time period specified by itself or the supplier company. After the lapse of this time period, no product replacement is made. The Company cannot replace products purchased from other stores.

The Company provides exclusively informational services and in no case encourages the purchase and/or use of a specific medicine, substance, product or service of a third party. Visitors/users/customers use the information of the Magazinedepot Online Pharmacy/Blog at their own risk, recognizing that in no case can they substitute medical advice, and the use of Products and information related to health issues should be done with the knowledge of the treating physician. In particular, the use of dietary supplements, available through the Online Pharmacy, is done exclusively and solely at the risk of the Customers.

Any reference or hyperlink to another website is provided for your convenience and the Online Pharmacy is not responsible for the content, security settings, products and services of such websites.

For Locker to Locker shipments, the delivery times are 2 business days for Mainland Greece from the day of receipt from the locker and 3 business days for Insular Greece and Cyprus.

For shipments made from an e-shop to Mainland Greece, it is 1 business day from the day of receipt of the package, 2 business days for Insular Greece and 3 business days for Cyprus.

17. Blog Magazinedepot / www.magazinedepot.gr

17.1. Product and company descriptions by the Company: The Company makes every effort to accurately describe the products and companies, however, it bears no responsibility for possible inaccuracies in the information provided by the holders of the production and distribution licenses for medicines and cosmetics or for possible errors that may be made when posting the Products.

The Company bears no responsibility whatsoever for the information concerning the Products (and in particular for the described indications/contraindications) and included in the description of the Products in the Online Store/Blog. All descriptions and information provided regarding the Products aim to present a general picture of them and in no case substitute for their detailed and precise instructions for use, which are incorporated into their packaging. Consequently, the Customer must always read the instructions for use incorporated into or enclosed in the packaging of the Product, and the Company is not responsible for any side effects, which have not been listed in the relevant field of the Online Store/Blog.

The descriptions of the Supplier Companies, as well as the producers, have been drawn from publicly accessible sources and the Company bears no responsibility for the accuracy or completeness of the description. In the event that a Supplier Company does not agree with its profile or the description of its products, it is requested to contact the Company directly.

17.2. Member/Visitor Posts: Members/Visitors are responsible for ensuring that any information, opinion, comment or review they post on the Magazinedepot blog does not infringe intellectual property rights, confidential information and/or personal data.

Members/Visitors undertake not to use vulgar or offensive language and that they will not post material that is or could be defamatory, abusive, libelous or intolerant, which could discredit products/companies or their reputation, clientele, personality or other users/visitors respectively.

The Company reserves the right to refuse to publish, delete or modify any post that does not comply with this term at its absolute discretion and without notice. Furthermore, the Company reserves the right to take any action it deems necessary (including but not limited to banning, removing, suspending, restricting access) in the event of misuse of the blog or unauthorized use.

The Company does not necessarily endorse, support, approve, encourage or agree with the comments, opinions, material, statements, expressed or provided by the users of the blog. Furthermore, the Company does not guarantee that the material posted on the blog by the Users is published with the permission of the copyright holder and therefore cannot guarantee that the material can be used freely.

In any case, the Company is not responsible for the selection, supervision or other type of control of the content of the Online Store/Blog and has no ability to intervene in the content of Product and company reviews, which are formed exclusively and solely by the relevant comments of visitors/members of the Online Store/Blog.

18. Security and Confidentiality: The Company makes every effort to maintain the confidentiality of the information entered by visitors/members/customers in the Online Store, which is necessary for the completion of the order and the shipment of the Products, as well as information relating to their health status or lifestyle (e.g. in the case of the “Ask Your Pharmacist” service).

19. Personal data: Visitors/members/customers may be asked to voluntarily provide information and data concerning them in order to register for services, receive updates, order Products and enjoy the services offered by the Online Pharmacy.

The processing of personal data is carried out in accordance with the provisions of the General Data Protection Regulation (GDPR 2016/679), any specific national and European legislation for certain sectors, the currently applicable Greek legislation on the protection of personal data, as well as on the protection of personal data and privacy in the field of electronic communications (Law 3471/2006, as applicable) and the decisions of the Personal Data Protection Authority (PDPA) for the following purposes:

* for any competitions held after their consent.

The Company maintains a file with the personal data of visitors/members/customers and does not transfer them to any third party (natural or legal person), with the exception of its associates (employees and external partners), who collaborate with the Company for operational and IT service purposes, as well as to the competent authorities in accordance with the applicable provisions.

The data subjects, namely the visitors/members/customers whose personal data are collected by the Company, have the following rights, under the specific terms and conditions of the legislation on the protection of personal data:

The advertised companies have their own advertising policy, and in no case is the Company responsible for the correctness/accuracy of the advertised company and/or the displayed product through the Online Pharmacy. The Company may not allow the display of advertising claims that, in its judgment, do not have sufficient scientific evidence to substantiate the claims they make.

The content of the Online Pharmacy is in no way related to the products or services displayed in the promotional activities of the advertised companies, and it is the responsibility of the advertised company to comply with the applicable provisions regarding the products or services displayed in the Online Store, as well as the manner of their display. The Company reserves the right to discontinue the promotion of a product or service if it finds that it is not in accordance with the law.

Visitors/members/customers expressly acknowledge and accept the fact that the Internet is not a completely secure environment, and that the Company is not responsible for any loss of data or other damage to the recipient or third parties due to either use or delayed transmission, interception, alteration or infection with viruses. The recipient is solely responsible for protecting his system from viruses and accepting electronic messages. The Company bears no responsibility for any direct or indirect damages that may arise from the use of the website, the transmission of data, or possible violation of the terms of use.

23. The resale of the Products available from the Electronic Pharmacy is prohibited.

24. In cases of shipment of products outside the European Union, the Company bears no responsibility for control and does not provide any guarantee regarding the delivery of the product outside the EU for any reason. In addition, the Company bears no responsibility in the event that the product to which the order relates is not approved by the competent supervisory body in the country of delivery of the Product, within and/or outside the European Union. In these cases, the shipping, return and any additional costs are entirely borne by the recipient.

25. The Company is not responsible for any additional charges/fees that may be imposed by the respective customs office of the country of delivery and which will be entirely borne by the recipients of the Products.

26. Within the framework of European Directive 2013/11/EC and Regulation No. 524/2013 of the European Parliament and of the Council, which were incorporated into Greek legislation by Joint Ministerial Decision 70330/2015, the possibility of electronic resolution of consumer disputes is provided through the Online Dispute Resolution (ODR) platform of the European Commission. According to the legislation, in the event that it is not possible to settle a direct complaint by the consumer or supplier to pharmacydepot cure and care, the following are provided:

where interested parties can contact the pharmacydepot cure and care company to resolve their disputes. The resolution of disputes concerns suppliers and consumers, sales and service contracts, domestic and cross-border disputes. The selection of the bodies is made jointly. With this reference to paragraph 26, it is considered that pharmacydepot cure and care as a supplier, provides all appropriate information for the resolution of disputes and is, according to its statement, always willing to make use of ADR and DRM, even if it is deemed impossible to resolve them with its consumers or suppliers.

27. In the event that any term herein is considered invalid, said term will be considered inapplicable and will not affect the validity or application of the remaining terms.

28. The above terms are subject to Greek Law and are interpreted in accordance with it. Any dispute arising from the use of this website or relating to these Terms is subject to the jurisdiction of the competent courts of Athens.
